DDCA apex council questions Ombudsman's order to reinstate Rajat Sharma

After Rajat Sharma handed a resignation letter, ombudsman Justice (Retd) Badar Durrez Ahmed has ordered that these resignations should be kept in abeyance and Sharma and his team should continue to discharge their duties. He added that the common thread running through the complaints filed by three officials - which happen to be from Sharma’s panel - is that a very serious and anarchic situation prevails in the administration of the affairs of DDCA which led to the forced resignation.

The Times of India reported that nine out of the 15 members of the Apex council addressed a joint presser, rejecting the Ombudsman's role and also highlighting the issues affecting the running of the sport in DDCA.

"We, the following members of the Apex Council, are of the opinion that you cannot rejoin the office as the president of DDCA and the mail stating your rejoining is null and void," the members of Apex council said in a letter to Sharma.

"A clear reading of section 168 (1) of the Companies Act, 2013 has made it clear that the resignation by a Director will be effective once served to the Company. There is no provision mentioned in the companies act 2013 to withdraw the resignation once submitted to the company."

After Sharma resigned, three other members - CEO Ravi Chopra and the two-member Cricket Advisory Committee (CAC) comprising Sunil Valson and Yashpal Sharma - also tendered their resignation from their respective duties.
